20.2.101    MODEL PROCEDURAL RULES

(1) The department of corrections has herein adopted and incorporated the attorney general's model procedural rules as published in ARM Title 1, chapter 3.   As the department of corrections is exempt from the

Montana Administrative Procedure Act in the areas of the supervision and administration of any penal institution with regard to the institutional supervision, custody, control, care and treatment of youths or prisoners, none of the above cited model rules shall apply to the above listed institutional functions. Modifications to the model rules for contested cases are set forth in sub-chapter 2 of this chapter.
