24.16.1002    GENERAL REQUIREMENTS

(1) Section 39-3-404 , MCA requires the payment of a minimum wage by an employer to his employees who are subject to the act. Section 39-3-405 MCA prohibits their employment for more than a specified number of hours per week without proper overtime compensation.

(2) By statutory definition the term "employ" includes (section 39-3-402 (2) MCA) "to suffer or permit to work".

(3) In general, "hours worked" includes all the time an employee is required to be on duty or on the employer's premises or at a prescribed workplace, and all time during which he is suffered or permitted to work for the employer.
