24.16.7541    DEFAULT ORDERS AND DISMISSALS

(1) A default order will be issued if the employer fails to timely file a written response to the determination.

(2) The default order will specify the amount owed by the employer to the employee as wages and penalty.

(3) A dismissal will be issued if the employee fails to timely file a written response to a determination or if no merit is found to the claim.

(4) Appeals of default orders and dismissals must be made in writing within 15 days of the date the default order or dismissal was mailed or served upon the requesting party.
