20.2.211    ON-SITE HEARING FOR PAROLE VIOLATION - FINDING

(1) The hearing officer shall render his decision verbally giving reasons for the finding. If probable cause is found, the hearing officer shall order one of the following:

(a) The parolee will be transported to Montana state prison for a hearing before the parole board.

(b) The parolee be reinstated to pursue an alternative plan due to the minor nature of the violation.

(2) If probable cause is not found, the parolee shall be returned to prehearing parole status.

(3) The hearing officer, at the conclusion of the hearing, shall prepare and distribute, within one week, the summary of preliminary hearing form (Form C) . This form shall contain the following information:

(a) Parolee's name and number.

(b) Date and place of hearing.

(c) Persons present at hearing.

(d) Alleged violation.

(e) Summarization of testimony and list of documents.

(f) Hearing officer's finding on case.

(g) Statement that parolee has been orally informed of the hearing officer's finding.
