42.12.136    CONDITIONS AND QUALIFICATIONS SPECIFIC FOR A BEER LICENSE AND A BEER LICENSE WITH WINE AMENDMENT FOR ON-PREMISES CONSUMPTION

(1) In addition to the provisions stated in ARM 42.12.122, which pertain to every type of alcoholic beverage license, with regard to beer licenses for on-premises consumption, a party applying for either a new license, transfer of ownership of an existing license, transfer of location of an existing license, or approval of an alteration to the premises:

(a) for a beer license with a wine amendment, must meet the standards for premises operated as either a restaurant or a prepared food business;

(b) must offer beer and/or wine by the drink; and

(c) may sell alcoholic beverages for off-premises consumption only in their original packages, an individual serving, or beer in refillable growlers.
