(1) If the department head or designee, or the state personnel division does not respond to an employee's appeal within the prescribed time limits in the appeals procedure, the employee may advance the appeal to the next step in the appeal procedure by forwarding his or her original copy of form and a new copy of form to the next step within 15 days of the expiration of the time limit.
