4.12.1408    PREVENTING SPREAD OF CONTAGIOUS DISEASE AMONG FRUIT TREES

(1)  For the purpose of preventing the spread of contagious diseases or insect pests among fruit and fruit trees, no fruit or vegetables infested with San Jose Scale (Aspidiotus pernicious)  , Putman Scale (Aspidotus ancylius)  , Oyster Shell Scale (Lepidosaphes ulmi)  , Coddline Moth (Cydea somenella)  , or any other dangerous insect discovered; or infected with Apple Scab (Venturia inequalis)  , Pear Scab (Venturia pyrina)  , Pear Blight (Bacullis amylovorous)  , Powdery Mildew (Phosphaeia oxyacantha)  , Bitter Rot (Glomerella ruformaculans)  , or any other dangerous disease discovered shall not be shipped from point of production unless written permission, accompanied by an affidavit, is granted to manufacture the said fruit into a suitable byproduct. An inspection certificate plainly marked as to the intended use shall be attached to the railcar or motor vehicle.
