37.5.601    PURPOSE

(1) The purpose of ARM 37.5.601 through 37.5.615 is to supplement those provisions of the Code of Federal Regulations (CFR) which provide the requirements nursing facilities must meet in order to participate in the Medicaid program, and which govern the certification of these facilities by the state survey agency for participation in the Medicaid program.

(2) All nursing facilities must be certified by the state survey agency in order to participate in the Medicaid program and receive reimbursement from that program. Nursing facilities must comply with the applicable provisions of 42 CFR parts 442, 483 and 488, updated through February 2004 as well as the definitions and standards outlined in this chapter. The department adopts and incorporates by reference 42 CFR parts 442, 483 and 488, updated through February 2004. (3) The state survey agency shall apply the applicable provisions of 42 CFR parts 442, 483 and 488, updated through February 2004, as well as the definitions and standards outlined in this chapter to both the survey and certification process and the informal dispute resolution process when issuing or reviewing a deficiency citation to a nursing facility.
